section 84 of the penal code :

- nothing is an offence which is done by a person who, by a time of doing it, by a reason of unsoundness of mind, is in capable of knowing the nature of the act or he is doing what is either wrong or contrary to law...

characteristic :

1. he can't understand others
2. can't empress himself
3. can't judge the consequences of his act
4. can't distinguish between good and bad or right and wrong
